After Cain Velasquez was denied bail yet again, the alleged victim speaks out for the first time
The following day of Cain Velasquez’s arrest, a report from The San Jose Mercury-News disclosed that Velasquez shot at a car comprising three individuals – including 43-year-old Harry Eugene Goularte, who had recently been accused of molesting a close relative. Velasquez apparently chased their truck and rammed his own truck into the side of their before firing several shots, one of which struck Goularte’s stepfather in the arm.
Back in March after roughly 25 minutes of prosecution by both sides, Judge Shelyna Brown denied Velasquez bail. He will remain held at the Santa Clara County main jail after Judge Brown called his alleged actions “reckless” and stated “the risk is too great” to release him. Velasquez is due back in court on April 12.
In a statement released by Judge Brown, it said, “Ramming a vehicle in the middle of the day where are citizens are out driving, going about their business and shooting out of a car at other individuals, which is reckless by any standard. Anyone could have been injured. Anyone could have been killed and when this court looks at article 1, section 12, it is this level of risk that the court must take into consideration. With that said, this court is making the ruling that the risk is too great and that there will be no bail set at this time.”
Since then, Velasquez has been denied bail twice after the man he’s accused of shooting back in February claimed he suffered serious injuries in the alleged attack.
Speaking to the court, the alleged victim said, “Good morning, your honor. My name is Paul Bender. I am the person who was driving the truck and the person shot by Cain Velasquez (on) February 28th, 2022,” Bender said. “We were simply following a court order to get a GPS monitoring device for Harry when Cain Velasquez started following us. He shot at us and chased us at speeds over a hundred miles an hour. When we came to a stop near a school, Cain Velasquez shot at us again, severing my brachial artery and nerve. I have lost the use of three fingers and can no longer work because I could not pass my (Department of Transportation) physical. Without the use of my right hand, we do not know if this loss is permanent.
“Cain Velasquez has no respect for human life. He could’ve easily shot the family in the car next to us, innocent pedestrians, or even young children. Cain Velasquez does not care who sees him do this. He does not care about the rule of law and has no respect for our judicial system. If given the opportunity, I believe he will try to finish what he started. I am fearful for my life, as well as for the lives of my family. No amount of bail or GPS monitor will stop Cain Velasquez. Respectfully, your honor, I ask that you please help keep my family safe and our community safe from Cain Velasquez and deny his request for bail.” [via BJPenn.com]
